AssaLamu'aLaikum. Seseorang udah pernah qurban 1 ekor kambing, tapi sebenarnya dia beLum aqiqah karena ktidaktahuan dia soAL agama". APAKAH QURBANYA DTRIMA ALLAH?

JAWAB:  Wa'alaikum Salam wr wb. Kesalahan karena ketidaktahuan diampuni oleh Allah SWT, sebagaimana kesalahan yang dilakukan karena terpaksa dan tidak sengaja.

Dari Ibu Abbas r.a., Rasulullaah Saw bersabda, "Sesungguhnya Allah mengampuni beberapa perilaku umatku, yakni (karena) keliru (akibat tidak tahu dan/atau tidak disengaja), lupa, dan terpaksa." (HR Ibnu Majah, Baihaqi, dan lain-lain. Hadits Hasan)
Lagi pula, hukum akikah tidak wajib. Hukum akikah Sunnah Muakkad, sunat yang sangat dianjurkan, khususnya bagi yang mampu. Akikah itu sunah bagi orangtua kita, saat kita baru lahir.

”Setiap anak yang dilahirkan itu terpelihara dengan aqiqahnya dan disembelihkan hewan untuknya pada hari ketujuh, dicukur dan diberikan nama untuknya” (HR. Imam yang lima, Ahmad dan Ashabush Sunan, dishohihkan oleh Tirmidzi).

Jika ia tidak memiliki kesanggupan untuk akikah hari ke-7, dibolehkan hari ke-14, 21, atau saat kapan pun ia (orangtua bayi) memiliki rezeki. Imam Syafi’i dan Hambali menyatakan, akikah bisa dilakukan sebelum atau setelah hari ketujuh. Harap diingat, yang bertanggung jawab melakukan akikah adalah sang ayah bayi.*

Kami belum/tidak menemukan dalil yang melarang seseorang berkurban jika belum melakukan akikah. Dengan kata lain, kurban boleh dilakukan meski ia belum melakukan akikahi atau diakikahi.

Menurut Imam Ahmad, kalau seseorang sudah berkurban, tidak perlu lagi melakukan akikah karena qurban tersebut telah mencukupi dan mewakili. 

Suatu ketika Imam Ahmad ditanya tentang kurban yang diperuntukkan untuk seorang anak, apakah hal itu sudah bisa menggantikan akikahnya? Beliau menjawab, "Aku tidak tahu. Akan tetapi ada yang berpendapat demikian. (Yaitu dari kalangan tabiin)." Imam Ahmad sendiri menegaskan, "Aku berharap semoga kurban yang dilakukan bisa menggantikan akikah orang yang belum diakikahi insya Allah." Wallahu a'lam bish-shawabi.*
