Berhubung bulan puasa pak ustadz, saya punya utang puasa yang tahun kemarin, ya lihat situasi kerjaan yang berat, bagaimana Hukum Bayar Utang Puasa dengan Fidyah, apa boleh?

JAWAB: Situasi pekerjaan yang berat, secara eksplisit tidak termasuk golongan orang yang mendapatkan keringanan tidak puasa dan membayar Fidyah.

Fidyah dalam puasa berlaku bagi orang yang benar-benar tidak mampu menunaikan qodho’ atau mengganti puasa di hari/bulan selain Ramadhan, seperti orang yang sudah tua renta yang tidak mampu lagi berpuasa, serta orang sakit dan sakitnya tidak kunjung sembuh.

“Dan wajib bagi orang-orang yang berat menjalankannya (jika mereka tidak berpuasa) membayar fidyah, (yaitu) memberi makan seorang miskin” (QS. Al Baqarah: 184).

Menurut Ibnu ‘Abbas, yang dimaksud dalam ayat tersebut adalah “untuk orang yang sudah sangat tua dan nenek tua, yang tidak mampu menjalankannya, maka hendaklah mereka memberi makan setiap hari kepada orang miskin”.

Kelompok yang Boleh Membayar Fidyah

Selengkapnya, kelompok orang yang terkenai hukum Fidyah adalah sebagai berikut:

  1. Orang yang sudah lanjut usia --keduanya wajib membayar fidyah kepada satu orang miskin untuk setiap hari yang ia tinggalkan (ia tidak bershaum) (HR. Al-Bukhari)
  2. Orang sakit yang sulit diharapkan kesembuhannya (HR. An-Nasa’i)
  3. Wanita hamil dan menyusui jika memang tidak mampu puasa karena khawatir terhadap janin atau anaknya (HR. Abu Daud & Thabrani).


Besarnya Fidyah adalah seporsi makan kepada satu orang miskin (yang mengenyangkan) untuk satu hari yang kita tinggalkan. Fidyah tidak boleh diganti dengan uang yang senilai dengan makanan karena dalam ayat dengan tegas dikatakan harus dengan makanan.

Menurut Lembaga Fatwa Mesir, Daar Iftaa', para ulama fiqih membolehkan orang yang bekerja kasar (keras) meninggalkan puasa, jika benar-benar tidak sanggup berpuasa, namun ia wajib mengqadha' puasa yang ditinggalkannya di lain hari, bukan dengan Fidyah.

Jika ia tidak menemukan hari luang hingga ia meninggal dunia, maka ia tidak terkena hukum wajib qodho', juga tidak terkena hukum wajib memberi wasiat bayar Fidyah.

Jika ia yakin atau mempunyai prediksi yang sangat kuat, bahwa ia tidak akan punya kesempatan untuk mengqadha' (mengganti) puasa di lain hari, maka ia dihukumi sebagaimana orang tua renta (boleh meninggalkan puasa dan harus membayar fidyah). Wallahu a’lam bish-showabi.*
