Bulan Ramadhan sebulan penuh, masih banyak yang susah menahan hawa napsu entah itu istri ataupun suami…La, kalau nggak tahan peluk dan cium apa boleh langsung tempel. Batal nggak puasanya?
Lalu bagaimana jika mencium dan bercvmbu dengan istri, apakah hal itu membatalkan puasa? Dari ‘Aisyah radliallahu ‘anha, beliau mengatakan:
كان رَسُولُ اللهِ صلى الله عليه وسلم يُقَبِّلُ وهُو صَائِمٌ وَيُباشِر وَهُو صَائِمٌ ولَكِنَّه كَان أَملَكَكُم لأَرَبِه
“Nabi shallallahu ‘alaihi wa sallam pernah mencium dan bercvmbu dengan istrinya ketika puasa, namun beliau adalah orang yang paling kuat menahan nafsunya.” (HR. Al Bukhari dan Muslim)
Dari Umar bin Khathab radliallahu ‘anhu, beliau mengatakan:
هَشَشتُ يَوْمًا فَقَبَّلْتُ وَأَنَا صَائِمٌ فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقُلْتُ صَنَعْتُ الْيَوْمَ أَمْرًا عَظِيمًا فَقَبَّلْتُ وَأَنَا صَائِمٌ
Suatu hari nafsuku bergejolak maka aku-pun mencium (istriku) padahal aku puasa, kemudian aku mendatangi Nabi shallallahu ‘alaihi wa sallam. Aku berkata: Aku telah melakukan perbuatan yang berbahaya pada hari ini, aku mencium sedangkan aku puasa. Maka Nabi shallallahu ‘alaihi wa sallam bersabda:
أَرَأَيْتَ لَوْ تَمَضْمَضْتُ بِمَاءٍ وَأَنْتَ صَائِمٌ
“Apa pendapatmu kalau kamu berkumur dengan air padahal kamu puasa?” Aku jawab: Boleh. Kemudian Nabi shallallahu ‘alaihi wa sallam bersabda: “Lalu kenapa mencium bisa membatalkan puasa?” (HR. Ahmad dan dishahihkan Syu’aib Al Arnauth)
Dalam hadis Umar di atas, Nabi shallallahu ‘alaihi wa sallam meng-qiyaskan (analogi) antara bercvmbu dengan berkumur.
Keduanya sama-sama rentan dengan pembatal puasa. Ketika berkumur, orang sangat dekat dengan menelan air.
Namun selama dia tidak menelan air maka puasanya tidak batal. Sama halnya dengan bercvmbu. Suami sangat dekat dengan keluarnya mani. Namun selama tidak keluar mani maka tidak batal puasanya.
Apakah yang tua dan muda boleh mencumbu (mubasyaroh) atau mencumbu istrinya ketika puasa?
An Nawawi berkata, “Adapun orang yang bergejolak syahwatnya, maka haram baginya melakukan semacam ini, menurut pendapat yang paling kuat dari Syafi’iyah. Ada pula yang mengatakan bahwa hal semacam ini dimakruhkan yaitu makruh tanzih (tidak sampai haram).
Sedangkan Al Qodhi mengatakan, “Sekelompok sahabat, tabi’in, Ahmad, Ishaq dan Daud membolehkan secara mutlak bagi orang yang berpuasa untuk melakukan semacam ini. Adapun Imam Malik memakruhkan hal ini secara mutlak.
Ibnu Abbas, Imam Abu Hanifah, Ats Tsauriy, Al Auza’i dan Imam Asy Syafi’i melarang hal ini bagi pasangan muda dan dibolehkan bagi yang sudah berusia senja.
Pendapat terakhir ini juga merupakan salah satu pendapat dari Imam Malik. Ibnu Wahb meriwayatkan dari Malik rahimahullah tentang bolehnya hal ini ketika melakukan puasa sunnah dan tidak bolehkan ketika melakukan puasa wajib.
Namun, mereka bersepakat bahwa melakukan semacam ini tidak membatalkan puasa kecuali jika keluar air mani ketika bercvmbu.
Para ulama tersebut berdalil dengan hadits yang sudah masyhur dalam kitab Sunan yaitu sabda Nabi shallallahu ‘alaihi wa sallam,
‘Bagaimana pendapatmu seandainya engkau berkumur-kumur?’ Makna hadits tersebut: Berkumur-kumur adalah muqodimah dari minum.
Kalian telah mengetahui bahwa melakukan hal tersebut tidaklah membatalkan puasa. Begitu pula dengan mencium istri adalah muqoddimah dari jima’ (bersetubuh), juga tidak membatalkan puasa.”
KesimpulanPendapat yang lebih hati-hati, jika memang yakin tidak bisa menahan syahwat, maka sebaiknya tidak mencumbu istri.
Masih ada waktu yang begitu longgar di malam hari. Namun jika yakin mampu menahan syahwat, maka tidak apa-apa mencumbu istri.
Tetapi dengan catatan, puasanya batal jika mencumbu istri lantas keluar mani. Jika keluarnya hanya madzi, maka tidak batal puasanya menurut pendapat paling kuat di antara para ulama sebagaimana hal ini pernah kami sampaikan.
