Bolehkah Mengunakan Kartu Kredit Saat Kondisi Mendesak?


Menerbitkan kartu kredit yang mengandung akad riba hukumnya haram. Hal ini ditegaskan oleh Majma’ Fiqih Al Islamiy (Divisi Fiqih OKI) dalam keputusan No. 108 (2/12) 2000, yang berbunyi,
“Tidak boleh menerbitkan/menggunakan kartu kredit tanpa jaminan rekening deposito, apabila ada persyaratan penambahan bunga riba. Sekalipun calon pemegang kartu bertekad melunasi kewajiban pembayaran pengembalian kredit pada waktu tenggang yang dibolehkan.”
Namun apakah keharaman ini berdampak kepada tidak sahnya seseorang menggunakan kartu kredit dalam kondisi mendesak?
Para ulama sepakat haram hukumnya mencantumkan persyaratan riba dalam akad qardh (kredit). Tetapi mereka berbeda pendapat tentang apakah pencantuman persyaratan riba merusak keabsahan akad qardh atau tidak?
Pendapat PertamaPara ulama madzab Maliki dan Syafi’i berpendapat bahwa akad qardh menjadi batal dan jika uang pinjaman sudah diambil, wajib dikembalikan saat persyaratan riba dibuat dan uang sama sekali tidak boleh digunakan.
Ibnu Syas (ulama madzab Maliki, wafat tahun 616 H) berkata,
“Disyaratakan untuk keabsahan akad qardh tidak mendatangkan keuntungan bagi pemberi pinjaman. Jika dibuat persyaratan bunga utang maka akad qardh menjadi batal. Tidak boleh uang pinjaman dipergunakan. Dan wajib dikembalikan saat itu juga.” (Iqdul Jawahir, 2:566)
A-Nawawi (ulama madzab Syafi’i, wafat th 676H) berkata, “Akad qardh dengan persyaratan bunga hukumnya haram… jika persyaratan riba dibuat maka akad qardh menjadi batal dan uang yang telah dipinjam tidak boleh digunakan.” (Raudhatuth Thalibin, 3: 275)
Dalil pendapat ini bahwa riba hukumnya tidak sah. Dengan demikian bila disyaratkan dalam akad qardh maka akad qardh ikut menjadi tidak sah karena akad qardh telah berpadu dengan riba.
Tanggapan:Dalil ini tidak kuat karena antara riba dan qardh bisa dipisahkan. Akad riba tidak sah dan dilarang, akan tetapi qardh dibolehkan. Allah subhanahu wa ta’ala berfirman,
وَإِنْ تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَالِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ
“Dan jika kamu bertaubat (dari pengambilan riba), maka bagimu pokok hartamu; kamu tidak menganiaya dan tidak (pula) dianiaya.“ (QS. Al Baqarah: 279)
Dalam ayat diatas, Allah mengakui pokok harta (pinjaman) dan membatalkan riba (bunga). Ini berarti akad qardh tetap sah dan yang batal hanyalah persyaratan riba. (Al Manfa’atu Fil Qardh, Dr. Abdullah Umrani, hal. 253)
Pendapat KeduaPara ulama madzab Hanafi dan Hanbali berpendapat bahwa persyaratan riba tidak sah dan tidak wajib dipenuhi akan tetapi akad qardh tetap sah.
Al Buhuty (ulama madzab Hanbali wafat th. 1051H) berkata, “Akad qardh tidak batal disebabkan keberadaan persyaratan yang tidak sah.”
Para ulama ini berdalil dengan hadis Barirah, seorang budak perempuan yang akan dimerdekakan oleh tuannya jika ia membayar uang sebanyak 9 Uqiyah (sekitar 1.071 gram emas 24 karat) maka iapun mendatangi ‘Aisyah radiyallahu’anha untuk menebusnya.
‘Aisyah radhiyallahu’anha berkata, “Jika tuanmu memindahkan perwalianmu untukku maka aku bersedia menebusmu.”
Barirah memberitahukan kepada tuannya apa yang diinginkan oleh ‘Aisyah, ternyata mereka menolak persyaratan ‘Aisyah.
‘Aisyah radhiyallahu’anha memberitahukan kasus Barirah kepada Nabi shallallahu’alaiahi wasallam. Maka Nabi shallallahu’alaihi wasallam bersabda,
َابْتَاعِيهاَ فَأَعْتِقِيهَا فَإِنَّ الوَلاَءَ لِمَنْ أَعْتَق
“Bayarlah tebusannya, lalu merdekakan. Sesungguhnya perwalian hanya milik orang yang memerdekakan.” (HR. Bukhari)
Dalam hadis diatas Nabi shallallahu’alaiahi wasallam tidak menganggap persyaratan perwalian tetap berada ditangan tuan Barirah.
Karena persyaratan tersebut tidak sah dan beliau menyuruh ‘Aisyah tetap membeli dan memerdekakannya dan perwalian menjadi milik ‘Asiyah.
Ini menunjukkan bahwa sebuah akad yang sah maka ketidak-absahan sebuah syarat tidak berdampak apapun terhadap keasbsahan akad. (Al Manfa’atu Fil Qardh, Dr. Abdullah Umrani, hal. 253)
Berdasarkan pendapat kedua yang mengatakan bahwa akad qardh tetap sah dan yang batal hanyalah persyaratan riba maka dalam keadaan yang mendesak seseorang dibolehkan menggunakan kartu kredit dengan syarat dia yakin mampu melunasi pengembalian kredit pada jangka waktu yang tidak dikenakan bunga atau penalti.
Pendapat inilah yang didukung oleh Syaikh Taqiyy Utsmani (peneliti ahli di Majma’ Al Fiqih Al Islamiy, divisi Fiqih OKI) (Al Bithaqat Al Bankiyyah, hal. 212)
